LEGATO WORLDWIDE LIMITED (“LWW”) strictly complies with the EU Digital Services Act (DSA), the Consumer Rights Directive (2011/83/EU), the General Data Protection Regulation (GDPR), and relevant laws and regulations of each member state, providing yoga apparel sales and related services to users (including consumers and corporate clients) within the EU (including the European Economic Area). These Terms clarify your rights and obligations with LWW regarding the use of the service and apply to all EU users who enjoy services through the LWW website and online/offline sales channels.
By using the services provided by LWW in any way, you are deemed to have fully read, understood, and agreed to all contents of these Terms, as well as LWW's privacy policy, return and exchange policy, shipping policy, and other related ancillary rules (collectively, the “Overall Terms”). If you do not agree to the Overall Terms, please do not use any of our services.
I. Service Content and Scope
1. Core Services:
LWW provides online and offline sales of yoga apparel, after-sales repair consultation, and product information consultation. Specific service content is subject to the information displayed on the official website and in order confirmation.
2. Service Restrictions:
LWW only provides services to persons with full civil capacity as defined by EU law; corporate clients must ensure they have legal business qualifications and that the purchased products meet their business scope requirements. Minors must use the service under the supervision of their legal guardians and may only purchase products appropriate to their age.
3. Platform Rules:
When using LWW's official website services, you must comply with the website's usage guidelines. You must not use the website to publish illegal information, maliciously attack the platform or other users, steal others' account information, or engage in fraudulent transactions.
II. Order and Contract Establishment
1. Order Submission:
When submitting an order through the official website or offline channels, you must accurately provide shipping information, payment information, and contact information. The order details (including product model, quantity, price, etc.) are subject to your final confirmation and payment.
2. Contract Establishment:
Submitting an order and completing payment constitutes an offer to purchase to LWW. A formal sales contract is established when LWW sends you an order confirmation via email or its official website. If your order information is incorrect, the product is out of stock, or the pricing is abnormal, LWW has the right to refuse the order and will promptly notify you, while also fully refunding your payment.
3. Price and Payment:
The order price is based on the amount displayed on the official website at the time of payment, including the product price and clearly marked related fees (shipping fees, etc.). VAT applicable within the EU will be calculated and displayed separately according to relevant regulations. You must complete payment promptly through a payment method approved by LWW; orders not paid within the stipulated time will be automatically cancelled.
III. User Rights and Obligations
1. User Rights:
You have the right to receive products and services that meet quality standards in accordance with the overall terms and conditions; the right to raise objections to service quality and request LWW to handle them according to regulations; the right to manage your personal data in accordance with GDPR and the relevant provisions of these terms and conditions; and the right to object to and complain about LWW's service review decisions (such as content deletion or order rejection).
2. User Obligations:
You must ensure that the personal information and order information you provide are true, accurate, and complete; you must properly safeguard your personal account information; you are solely responsible for any losses incurred due to account leakage or theft caused by your own reasons; after receiving the product, you must use and maintain it correctly according to the product instructions and care guidelines.
IV. Product Quality and Guarantee
1. Quality Standards:
All yoga apparel shipped by LWW to the EU complies with relevant EU safety, environmental, and quality standards, has passed CE certification, and provides compliant product labels and instructions for use.
2. Warranty Service:
The product is provided with a standard warranty period from the date of receipt (the specific period is subject to the product instructions). During the warranty period, if the product has quality problems due to non-human damage, you can apply for free repair, replacement, or return; the repaired product will enjoy an additional 12-month warranty period, in accordance with the relevant requirements of the EU "Right to Repair" Directive.
3. Limitation of Liability:
LWW is not liable for product damage caused by improper use or maintenance (such as use beyond the product's applicable scenario, failure to care for the product according to washing instructions) or force majeure, but can provide paid repair consultation services.
V. Advertising and Marketing Compliance
1. Advertising Disclosure:
LWW will clearly indicate the nature of all marketing advertisements published through its official website, emails, and other channels, and will inform the payer and the reason for display, complying with the relevant requirements of the Digital Services Law.
2. Targeted Advertising Restrictions:
LWW will not target advertisements based on your religious beliefs, ethnicity, health status, or other sensitive information; it strictly prohibits targeting minors with marketing content inappropriate for their age.
3. Unsubscribe Right:
If you do not wish to receive marketing emails or messages from LWW, you can unsubscribe through the unsubscribe function in the email or by contacting service@lwwlimited.com. After unsubscribing, LWW will stop sending you unnecessary marketing information.
VI. Intellectual Property Protection
LWW Intellectual Property: All intellectual property rights of the content on the LWW official website (including text, images, design, logo, product appearance, etc.) belong to LWW. Without authorization, you may not copy, disseminate, modify, or use it for commercial purposes.
VII. Illegal Content and Complaint Handling
1. Prohibition of Illegal Content:
You may not publish or disseminate any content that violates EU laws and public order and good morals through LWW services, including but not limited to illegal product information, hate speech, infringing content, false advertising, etc.
2. Complaints and Feedback:
If you find any illegal content or service violations on the platform, you can submit a complaint at service@lwwlimited.com, providing detailed evidence (such as screenshots, order numbers, etc.). LWW will verify and process the complaint within 7 business days of receiving it and provide you with feedback on the results.
3. Review Explanation:
If LWW takes measures such as deletion or account function restriction due to your publication of illegal content, it will provide you with a written explanation and upload it to the transparency database stipulated in the Digital Services Act as required. If you disagree with the review results, you may apply for a review.
VIII. Limitation of Liability and Exemption
1. Limitation of Liability:
LWW shall be liable for direct losses arising from the provision of services, but the amount of compensation shall not exceed the actual payment amount of your corresponding order; LWW shall not be liable for indirect losses (such as loss of profits, loss of expected revenue) unless such loss is caused by LWW's intentional or gross negligence.
2. Exemption from Liability:
LWW shall not be liable for service interruptions or losses caused by the following reasons:
- (1) Force majeure (extreme weather, natural disasters, war, logistics strikes, temporary adjustments to EU policies, etc.);
- (2) Your own operational errors or incorrect information provided;
- (3) Third-party service failures (such as payment system, logistics system anomalies);
- (4) Other reasonable reasons beyond LWW's control.
3. Third-Party Links:
The LWW website may contain links to third-party websites. The services of such websites are unrelated to LWW, and LWW shall not be liable for their content or service quality. You shall bear the risk of accessing third-party links yourself.
IX. Terms Updates and Applicable Law
1. Terms Updates:
LWW has the right to update these Terms in accordance with changes in EU laws and regulations, business adjustments, etc. The updated terms will be communicated to you via official website announcements, email notifications, etc., and will take effect from the date of publication. Your continued use of the service constitutes your agreement to the updated terms.

X. Dispute Resolution

Any dispute arising between you and LWW regarding the service shall first be resolved through friendly negotiation. Negotiation can be conducted via service@lwwlimited.com.
2. Complaints and Arbitration:
If negotiation fails, you may file a complaint with the consumer protection agency or the Digital Services Coordinator (DSC) of your Member State; or, as agreed by both parties, file a lawsuit or apply for arbitration in a court with jurisdiction within the EU.
